In December 2019, New York State passed the “Nuisance Call Act,” prohibiting anyone from “knowingly making unsolicited sales calls to [anyone]……during a declared state of emergency.” This includes B2B calling!

Earlier this month, New York governor Andrew Cuomo declared a state of emergency due to the spread of the coronavirus in the state, therefore any telemarketing or other unsolicited sales calls or text messaging to anyone in NY is illegal! And this declaration may last until September 7, 2020.

If your company is making these types of calls or texts, as part of your sales and marketing, to anyone in New York State, we strongly recommend you stop now. Even if your company is located in another state!

New York has setup a hotline and website for their residents to register their complaints, and the governor has indicated New York will act “swiftly to stop these people from preying on our citizens!”

This is NOT just a New York issue. 12 other states have similar regulations and more than 20 others have language about this in committee as we write this! Check with your local state and the states you do business with to see what laws they have in place!

We’re here for you and we will keep you informed about any developments on this, or anything else that might impact your business!
